1. OUR SERVICES

NoMissDesk sets up and manages communication tools for businesses, including missed-call text-back, an AI receptionist that answers calls and books appointments, and automated Google review requests. Specific features and pricing are confirmed in your order or agreement.

2. FEES AND BILLING

- Services include a one-time setup fee and a monthly subscription fee, as stated at signup.

- Monthly fees are billed in advance and renew automatically each month until cancelled.

- Usage-based costs (such as phone, text-message, or AI voice minutes beyond your plan) may be billed separately, as agreed at signup.

3. FIRST-MONTH GUARANTEE

If our service does not catch at least one call you would have otherwise missed during your first 30 days of active service, we will refund your first monthly fee upon request. The setup fee is non-refundable. Requests must be made within 45 days of your service start date.

4. CANCELLATION

You may cancel at any time by emailing us. Cancellation takes effect at the end of your current billing period. We do not provide partial-month refunds except as described in the First-Month Guarantee.

5. YOUR RESPONSIBILITIES

- You agree to provide accurate business information, including information needed for text-messaging registration with phone carriers.

- You are responsible for having proper consent to contact your customers and for following applicable laws, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.

- You agree not to use our services for spam, illegal, or harmful purposes.

6. TEXT MESSAGING TERMS

By providing your mobile number and opting in, you agree to receive text messages from NoMissDesk about your demo, inquiry, or account, such as appointment confirmations and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time. Reply HELP for help, or contact us at [email protected]. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

7. AI AND AUTOMATED TOOLS

Our AI receptionist and automations are designed to help you capture and respond to leads, but they may occasionally make mistakes or miss information. You are responsible for reviewing bookings and messages and for any final decisions made with customers.

8. NO GUARANTEE OF RESULTS

Except for the First-Month Guarantee, we do not guarantee a specific number of calls, jobs, reviews, revenue, or search rankings.

9. SERVICE AVAILABILITY

We rely on third-party platforms and phone carriers and cannot guarantee uninterrupted service. We are not responsible for outages or delays caused by those providers.

10. LIMITATION OF LIABILITY

To the fullest extent allowed by law, NoMissDesk is not liable for indirect, incidental, or consequential damages, including lost profits or lost business. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

11. TERMINATION

We may suspend or end services if you violate these Terms, fail to pay, or use the services unlawfully.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Texas.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. Continued use of our services means you accept the updated Terms.
